AGREEMENT TO OUR LEGAL TERMS

We are a The Learning Mate ('Company', 'we', 'us', or 'our'), our contact address is (“Street Israa 6003, 83, Zahraa Maadi, Cairo, Egypt”)

We operate the website, as well as any other related products and services that refer or link to these legal terms (the 'Legal Terms') (collectively, the 'Services').

The Learning Mate is an AI-powered educational assessment and grading platform that helps educators streamline their exam workflow. Teachers and students can upload student exams (either as PDFs or images), and the platform uses artificial intelligence to automatically grade the work, provide detailed feedback, and generate annotated PDFs. The system supports automated exam grading, student management, course organization, and comprehensive analytics to track student performance over time. The Learning Mate is built as a modern web application with a user-friendly dashboard where teachers can create courses, manage students, publish assignments, track grades, and handle all aspects of their assessment workflow. The platform is designed to save educators significant time by automating the tedious process of grading while maintaining accuracy and providing meaningful feedback to help students improve their learning outcomes.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and The Learning Mate, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide at least 30 days’ notice of material changes to these Legal Terms by email and/or in-app notification. The updated Legal Terms will become effective on the date stated in the notice (or, if no date is stated, upon posting).

Age and Student Use. The Services are intended for use by educators and authorized school or institutional personnel. Students may access the Services only when invited or enabled by an educator, school, or parent/guardian, and only for educational purposes. If you are under the age of 18 (or the age of majority where you live), you may use the Services only with the involvement, consent, and supervision of your parent/guardian or your school/institution, as applicable. We do not knowingly permit children under 13 to create an account. If we learn that a child under 13 has created an account, we will take steps to delete it and associated data.

We recommend that you print a copy of these Legal Terms for your records.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the 'Content'), as well as the trademarks, service marks, and logos contained therein (the 'Marks').

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties around the world.

The Content and Marks are provided in or through the Services 'AS IS' for your internal business purpose only.

Your use of our Services

Subject to your compliance with these Legal Terms, including the 'PROHIBITED ACTIVITIES' section below, we grant you a non-exclusive, non-transferable, revocable licence to:

  • access the Services; and

  • download or print a copy of any portion of the Content to which you have properly gained access,

solely for your internal business purpose.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

If you wish to make any use of the Services, Content, or Marks other than as set out in this section or elsewhere in our Legal Terms, please address your request to: support@thelearningmate.com. If we ever grant you the permission to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owners or licensors of the Services, Content, or Marks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our Content.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks.

Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

Your submissions and contributions

Please review this section and the 'PROHIBITED ACTIVITIES' section carefully prior to using our Services to understand the (a) rights you give us and (b) obligations you have when you post or upload any content through the Services.

Submissions. If you submit questions, comments, or general feedback regarding the Services (“Submissions”), such Submissions are treated as Feedback and are governed by the “Feedback” section below. Submissions do not include Customer Data, student work, exam content, or educational records.

Contributions: The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality during which you may create, submit, post, display, transmit, publish, distribute, or broadcast content and materials to us or through the Services, including but not limited to text, writings, video, audio, photographs, music, graphics, comments, reviews, rating suggestions, personal information, or other material ('Contributions'). Any Submission that is publicly posted shall also be treated as a Contribution.

You understand that Contributions may be viewable by other users of the Services.

Feedback. If you voluntarily submit ideas, suggestions, or feedback regarding the Services (“Feedback”), you grant The Learning Mate a non-exclusive, worldwide, royalty-free license to use such Feedback solely to operate, maintain, and improve the Services. Feedback does not include student exam content or educational records. We will not use Feedback for marketing or advertising without your explicit consent.

This licence includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide.

You are responsible for what you post or upload: By sending us Submissions and/or posting Contributions through any part of the Services or making Contributions accessible through the Services by linking your account through the Services to any of your social networking accounts, you:

  • confirm that you have read and agree with our 'PROHIBITED ACTIVITIES' and will not post, send, publish, upload, or transmit through the Services any Submission nor post any Contribution that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading;

  • to the extent permissible by applicable law, waive any and all moral rights to any such Submission and/or Contribution;

  • warrant that any such Submission and/or Contributions are original to you or that you have the necessary rights and licences to submit such Submissions and/or Contributions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions and/or Contributions; and

  • warrant and represent that your Submissions and/or Contributions do not constitute confidential information.

You are solely responsible for your Submissions and/or Contributions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party's intellectual property rights, or (c) applicable law.

We may remove or edit your Content: Although we have no obligation to monitor any Contributions, we shall have the right to remove or edit any Contributions at any time without notice if in our reasonable opinion we consider such Contributions harmful or in breach of these Legal Terms. If we remove or edit any such Contributions, we may also suspend or disable your account and report you to the authorities.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not under the age of 13; (5) if you are under the age of majority where you live, you have the consent and supervision required under the ‘Age and Student Use’ section above; (6) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (7) you will not use the Services for any illegal or unauthorised purpose; and (8) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

4. USER REGISTRATION

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. PURCHASES AND PAYMENT

We accept the following forms of payment:

  • Stripe

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments are charged in Euros (EUR). Local pricing references are indicative and may be converted based on your payment provider, applicable taxes, and exchange rates.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors.

Pricing Structure

Free Plan:

  • Duration: 1 year from signup

  • Quota: 20 exam corrections

  • No auto-renewal; manual upgrade required for continued service

Pro Plan:

  • Base pricing: €20/month (Egypt region) or €25/month (other regions)

  • Base quota: 200 exam corrections per month

  • Adjustable quantity: You may purchase 1-50 units, with each unit multiplying your base quota

  • Example: Purchasing 3 units = €75/month with 600 exam corrections (200 × 3)

Usage Calculation: Exam corrections are consumed based on grading mode and exam length:

  • Standard Mode: 1-2.5 usage units per exam (depending on page count)

  • Premium Mode (Human Verified): 1.5-3.75 usage units per exam

  • Instant Mode: 2-5 usage units per exam

Page count affects usage calculation:

  • 1-2 pages: Lower usage rate

  • 3-10 pages: Base usage rate

  • 11-18 pages: Moderate increase

  • 19-30 pages: Higher usage rate

  • 30+ pages: Maximum usage rate

Refunds and Cancellations

Except where required by applicable law, subscription fees are non-refundable. You may cancel your subscription at any time, and your subscription will remain active until the end of the current billing period.

Proration. Subscription upgrades take effect immediately and may result in a prorated charge for the remainder of the billing cycle. Downgrades take effect at the start of the next billing cycle and are not prorated.

Taxes. Prices displayed exclude applicable taxes unless otherwise stated. We may collect value-added tax (VAT), sales tax, or similar taxes where required by law, based on your billing location.

Failed Payments. If a payment fails, we may retry the charge and notify you. If payment is not successfully completed within a reasonable grace period, we may suspend or limit access to the Services until payment is resolved.

6. SUBSCRIPTIONS

Billing and Renewal

Your subscription will continue and automatically renew unless cancelled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. The length of your billing cycle is monthly.

Free Trial

Free Trial / Trial Quota. New accounts may receive a trial units quota which is up to 20 exam correction units. Trial availability and limits may vary by region or promotion and may be changed or discontinued at any time.

Cancellation

You can cancel your subscription at any time by logging into your account or through the Stripe Customer Portal. Your cancellation will take effect at the end of the current paid term.

Plan Downgrades: If you downgrade your subscription, the changes will take effect at the beginning of your next billing cycle, not immediately. You will retain your current plan benefits until the end of your current billing period.

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.

  • Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.

  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.

  • Use any information obtained from the Services in order to harass, abuse, or harm another person.

  • Make improper use of our support services or submit false reports of abuse or misconduct.

  • Use the Services in a manner inconsistent with any applicable laws or regulations.

  • Engage in unauthorised framing of or linking to the Services.

  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.

  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

  • Delete the copyright or other proprietary rights notice from any Content.

  • Attempt to impersonate another user or person or use the username of another user.

  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ('gifs'), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as 'spyware' or 'passive collection mechanisms' or 'pcms').

  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.

  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.

  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.

  • Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.

  • Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorised script or other software.

  • Use a buying agent or purchasing agent to make purchases on the Services.

  • Make any unauthorised use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.

  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.

  • Sell or otherwise transfer your profile.

  • Exceed your allocated usage quota or attempt to circumvent usage limits.

8. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

9. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy: Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. Please be advised the Services are hosted in the European Union (currently including France/EU regions). If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in France, then through your continued use of the Services, you are transferring your data to France, and you expressly consent to have your data transferred to and processed in France.

  1. Customer Data and Exam Content License

Ownership. You retain all right, title, and interest in and to all exam materials, student submissions, student work, grades, feedback, and other content that you upload, submit, or otherwise make available through the Services (“Customer Data”). Nothing in these Legal Terms transfers ownership of Customer Data to The Learning Mate.

Limited License to Operate the Services. You grant The Learning Mate a limited, non-exclusive, non-transferable, revocable license to host, store, process, analyze, and display Customer Data solely as necessary to provide, maintain, and improve the Services, including automated grading, feedback generation, analytics, reporting, and customer support.

No Advertising Use. We do not use Customer Data or student work for advertising, marketing, or promotional purposes.

No AI Model Training. Customer Data, including student exam content and submissions, is not used to train, fine-tune, or improve general-purpose machine learning or AI models. Customer Data is processed only to generate results for the specific exams and courses you submit.

Data Minimization. Where possible, we minimize the personal data shared with third-party processors and limit processing to the information required to perform the requested grading and feedback services.

11. THIRD-PARTY SERVICE PROVIDERS

To provide and operate the Services, we use third-party service providers to process your data. Each provider maintains their own privacy policy and data processing terms.

Categories of Third-Party Services

To deliver automated grading and feedback, The Learning Mate uses third-party artificial intelligence service providers listed in our Subprocessor List available in our Privacy Policy. These providers process exam content securely via API connections and only for the purpose of providing the requested Services.

Data Shared. Depending on the grading mode, we may transmit exam files, extracted text, and relevant grading context. We minimize the inclusion of personal identifiers where possible.

Opt-Out Options. Certain processing modes may be optional or configurable within your account settings. Disabling AI-based features may limit functionality.

Cloud Storage and Infrastructure: All uploaded files (exam PDFs, images, student answer papers, and graded results) are stored on secure cloud servers located within the European Union to ensure GDPR compliance and data sovereignty.

Payment Processing: Payment and subscription information is processed by PCI-DSS compliant third-party payment processors. These providers handle payment card details, billing addresses, and transaction history according to industry security standards.

Communication Services: Transactional emails (password resets, notifications, account updates) and SMS messages (one-time password verification) are delivered through third-party communication service providers.

Authentication Services: We offer authentication via third-party single sign-on (SSO) providers. If you choose to connect external accounts (such as Google accounts), we may access your profile information, courses, and related data to provide integration features like automatic grade syncing.

Analytics and Monitoring (Optional): We may use third-party analytics and monitoring services to improve service quality, detect errors, and understand usage patterns. These services process anonymized or aggregated data. Analytics features can be disabled in your account settings where applicable.

Data Processing Terms

By using the Services, you acknowledge and agree that:

  1. AI Processing: Your exam content and student data will be processed by third-party AI service providers for the purpose of automated grading and feedback generation.
  1. Data Processing Agreements: We work with reputable third-party providers who maintain industry-standard security and privacy practices.
  1. International Transfers: Third-party providers may process data outside your jurisdiction, including in the United States and other countries. By using the Services, you consent to international data transfers necessary to provide the Services.
  1. Your Responsibilities: You are responsible for obtaining necessary consents from students and parents/guardians for AI processing of exam content in accordance with applicable laws and your institution's policies.
  1. No Data Sales: We do not sell your data or student data to third parties for marketing, advertising, or any commercial purpose unrelated to providing the Services.
  1. Subprocessor List: For a complete list of our current third-party service providers (subprocessors), please see our Privacy Policy or contact us at support@thelearningmate.com.

Educational Institution Notice

For educational institutions:

  • We process student educational records solely to provide the Services

  • We recommend reviewing your institution's data protection and privacy policies before using AI-powered grading services

  • Educational institutions are responsible for ensuring compliance with applicable laws (such as FERPA in the United States or GDPR in the European Union)

12. AI PROCESSING AND ACCURACY

AI-Powered Grading

The Services use artificial intelligence models from multiple leading AI technology providers to automatically grade student exams, extract answers, and provide feedback. We employ frontier AI models from industry-leading companies to ensure high accuracy and reliability. You acknowledge and agree that:

  1. AI Limitations: AI grading is not perfect and may contain errors, misinterpretations, or inaccuracies. Automated grading should be reviewed by qualified educators before final grade submission.
  1. No Guarantee of Accuracy: We do not warrant that AI-generated grades, feedback, or corrections are accurate, complete, or suitable for any particular purpose. The AI models are tools to assist educators, not replace human judgment.
  1. Review Responsibility: Instructors and educators are solely responsible for reviewing AI-generated grades and feedback before publishing results to students. We provide review and correction tools for this purpose.
  1. Model Changes: AI models may be updated, changed, or replaced at any time, which may affect grading consistency or output format.
  1. Content Processing: Exam content (including student handwriting, typed responses, images, and PDFs) is sent to third-party AI providers for processing. By uploading exams, you confirm you have the right to share this content with AI processing services.
  1. Educational Use Only: AI grading is intended for educational assessment purposes only and should not be used for high-stakes testing, certification exams, or legal evaluations without additional human verification.

Grading Modes

We offer three grading modes with different processing speeds, accuracy levels, and verification methods:

Standard Mode:

  • AI-only grading using advanced language models

  • Expected completion: Within 24 hours

  • Usage: 1-2.5 units per exam (based on page count)

  • Best for: Regular assignments and formative assessments

Instant Mode:

  • Expedited AI-only grading with priority processing

  • Expected completion: Immediate (real-time grading)

  • Usage: 2-5 units per exam (based on page count)

  • Best for: Quick feedback needs and time-sensitive grading

Premium Mode (Human Verified):

  • Two-stage grading process: AI grading followed by expert human review

  • AI generates initial correction automatically

  • Internal expert reviewers verify and refine AI results

  • Expected completion: Within 36 hours

  • Usage: 1.5-3.75 units per exam (based on page count)

  • Best for: High-stakes assessments, final exams, and situations requiring highest accuracy

Human Verification in Premium Mode

For exams graded in Premium Mode:

  1. Initial AI Grading: The exam is first graded by advanced AI language models to generate an initial correction and feedback.
  1. Expert Human Review: Our internal team of trained reviewers (education professionals with subject matter expertise) manually review the AI correction to:
  • Verify the accuracy of AI grading decisions

  • Correct any AI errors or misinterpretations

  • Refine feedback for clarity and educational value

  • Ensure grading consistency with the mark scheme

  1. Final Results: The human-verified correction replaces or supplements the AI correction, providing higher accuracy and reliability.
  1. Review Request System: Premium mode automatically creates a review request that is assigned to available reviewers based on subject expertise and workload.
  1. No Guarantee of Perfection: While human verification significantly improves accuracy, we do not guarantee that Premium Mode corrections are error-free. Instructors remain responsible for final review before publishing grades to students.

Human reviewers are bound by confidentiality obligations and access student exam content solely for the purpose of verifying grading accuracy. Reviewers are granted the minimum access necessary and are prohibited from retaining, copying, or using exam content outside the review process.

Reviewer Qualifications

Our internal reviewers are:

  • Education professionals or subject matter experts

  • Trained on our grading standards and AI correction review procedures

  • Not affiliated with the instructors or students whose exams they review

  • Subject to quality control and performance monitoring

Reviewers do not have access to student personal information beyond what is necessary for grading (student answers and exam content).

Usage Unit Calculation

All grading modes calculate usage units based on exam page count:

  • 1-2 pages: Lower usage rate

  • 3-10 pages: Base usage rate

  • 11-18 pages: Moderate increase

  • 19-30 pages: Higher usage rate

  • 30+ pages: Maximum usage rate

13. DATA RETENTION

Personal Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with the Services. Specifically:

Active Accounts:

  • User account information, profile data, and credentials are retained while your account is active

  • Course data, student rosters, and exam records are retained indefinitely while your account is active

  • Uploaded files (exam PDFs, images, graded results) are stored in AWS S3 for the duration of your account

Account Deletion: Upon account deletion (either by you or by us), we will:

  • Immediately delete your account credentials and authentication tokens

  • Permanently delete your personal information (name, email, phone number) from our primary database

  • Delete all uploaded exam files from AWS S3 storage within 30 days

  • Remove associated course data, student records, and exam corrections

  • Cascade delete related data including sessions, API keys, and verification tokens

Temporary Data:

  • Session tokens: Expire and are eligible for deletion after expiration

  • OTP verification codes: Expire after 10 minutes for password reset; cleanup occurs periodically

  • Password reset tokens: Expire after 1 hour

  • OAuth tokens: Refreshed and expired tokens are replaced automatically

Backup and Recovery:

  • We maintain regular database backups for disaster recovery purposes

  • Backup copies containing your data may be retained for up to 30 days after deletion

  • Backups are securely stored and automatically purged after the retention period

Legal Retention: Notwithstanding the above, we may retain certain data if required by law, to comply with legal obligations, resolve disputes, enforce our agreements, or for legitimate business purposes. Such retention will be limited to the minimum period required by applicable law.

Data Export Before Deletion: We recommend requesting a copy of your data before deleting your account. Contact support@thelearningmate.com for data export requests. Please allow up to 30 days for data compilation and delivery.

Anonymized Data

We may retain anonymized, aggregated, or de-identified data indefinitely for analytics, research, and service improvement purposes. This data cannot be used to identify you personally.

14. DATA PROTECTION RIGHTS

If you are located in the European Economic Area (EEA), United Kingdom, Switzerland, or other jurisdictions with data protection laws, you may have certain rights regarding your personal data.

For accounts used by educators or educational institutions, The Learning Mate acts as a data processor (or “service provider”) with respect to student personal data, and the educational institution or instructor acts as the data controller under applicable data protection laws, including the GDPR.

We process student data only on documented instructions from the controller and solely to provide the Services. We do not use student data for our own independent purposes.

We offer Data Processing Agreements (DPAs) for educational institutions upon request. Please contact support@thelearningmate.com for institutional agreements.

Your Rights

You have the following rights regarding your personal data:

  1. Right of Access: You may request access to your personal data and receive a copy of the data we process about you.
  1. Right to Rectification: You may request correction of inaccurate or incomplete personal data.
  1. Right to Erasure ("Right to be Forgotten"): You may request deletion of your personal data in certain circumstances, including when the data is no longer necessary for the purposes for which it was collected.
  1. Right to Data Portability: You may request to receive your personal data in a structured, commonly used, and machine-readable format, and have the right to transmit that data to another controller.
  1. Right to Restrict Processing: You may request restriction of processing of your personal data in certain circumstances.
  1. Right to Object: You may object to processing of your personal data based on legitimate interests or for direct marketing purposes.
  1. Right to Withdraw Consent: Where we rely on consent as the legal basis for processing, you may withdraw your consent at any time. This does not affect the lawfulness of processing based on consent before its withdrawal.
  1. Right to Lodge a Complaint: You have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your habitual residence, place of work, or place of the alleged infringement.

Please note: Data export functionality for machine-readable formats is currently under development. For data portability requests, we will provide your data in available formats (PDF, CSV, JSON) and will work with you to accommodate your specific needs. Please allow up to 30 days for data compilation and delivery.

Legal Basis for Processing

We process your personal data to:

  • Provide the Services you've requested and fulfill our contractual obligations

  • Obtain your consent for certain processing activities (e.g., marketing communications, third-party integrations)

  • Improve our Services, prevent fraud, and maintain security

  • Comply with applicable laws and regulations

International Data Transfers

Your data may be transferred to and processed in countries outside your jurisdiction, including the United States and other countries where our service providers operate. 15. STUDENT DATA PROTECTION

Educational Context

The Learning Mate is designed for use in educational settings where instructors grade student exams. We recognize the sensitive nature of student educational records and are committed to protecting student privacy.

Student Data We Process

When you use the Services, we may process the following student data:

  • Student names and identification numbers

  • Email addresses and contact information

  • Class enrollment and course participation

  • Exam answers and submissions (text, handwriting, images)

  • Grades, scores, and performance analytics

  • Feedback and comments from instructors

Our Commitments

We commit to the following principles regarding student data:

  1. No Sale of Student Data: We do not sell, rent, or trade student data to third parties for marketing, advertising, or any commercial purpose unrelated to providing the Services.
  1. Limited Use: Student data is used solely for educational purposes—specifically, to provide automated grading, feedback, and performance analytics to instructors and students.
  1. No Behavioral Advertising: We do not use student data to target advertisements or build marketing profiles.
  1. Transparency: We clearly disclose what student data we collect, how it's used, and with whom it's shared (see Section 12: Third-Party Service Providers).
  1. Security: We implement appropriate technical and organizational measures to protect student data from unauthorized access, disclosure, or loss (see Section 17: Security Measures).

Instructor Responsibilities

As an instructor using The Learning Mate, you are responsible for:

  1. Obtaining necessary consents from students and/or parents/guardians before uploading student exam data

  2. Ensuring compliance with your institution's data protection and privacy policies

  3. Informing students that their exam content will be processed by AI service providers listed in our Subprocessor List (see our Privacy Policy)

  4. Reviewing AI-generated grades before publishing final results to students

  5. Only uploading exam content that you have the right to share

Parent and Guardian Rights

Parents and legal guardians of minor students have the right to:

  • Access their child's educational records processed through The Learning Mate by contacting the instructor or educational institution

  • Request correction or deletion of inaccurate student data

  • Withdraw consent for AI processing (where applicable), which may limit the Services available to the student

Institutional Agreements

Educational institutions using The Learning Mate for classroom purposes may require separate agreements addressing data processing, privacy, and compliance requirements. Please contact support@thelearningmate.com to discuss institutional agreements.

16. SECURITY MEASURES

We implement commercially reasonable technical and organizational security measures to protect your data from unauthorized access, disclosure, alteration, and destruction. Our security practices include:

Security and Retention Practices

We use industry-standard security measures to protect your data, including encryption in transit, secure credential storage, access controls, and regular monitoring. Specific technical implementations may evolve over time as we improve our security posture.

We retain Customer Data only for as long as necessary to provide the Services or as required by law. Upon account deletion, we will delete or anonymize Customer Data within a reasonable period, typically within 30 days, except where legal obligations require longer retention.

Backup copies may be retained for a limited period for disaster recovery purposes and are securely deleted according to our retention policies.

Organizational Safeguards

  1. Access Restrictions: Access to production systems and user data is limited to authorized personnel only

  2. Logging and Monitoring: Security logging and monitoring to detect and investigate incidents

  3. Regular Backups: Automated database backups for disaster recovery

  4. Vendor Security: We rely on industry-leading providers (AWS, Stripe, Google Cloud) with robust security certifications

Data Breach Notification

In the event of a data breach that affects your personal information or student data, we will:

  1. Investigate and assess the scope and impact of the breach

  2. Notify affected users via email in a timely manner

  3. Provide details about the nature of the breach, data affected, and steps we're taking to address it

  4. Comply with applicable data breach notification laws

  5. Cooperate with law enforcement and regulatory authorities as required

Limitations

While we implement strong security measures, no system is completely secure. You acknowledge that:

  • Internet-based services carry inherent security risks

  • You are responsible for maintaining the confidentiality of your account credentials

  • You should immediately notify us of any unauthorized access to your account at support@thelearningmate.com

We cannot guarantee absolute security, but we continuously work to improve our security practices and promptly address identified vulnerabilities.

17. API USAGE TERMS

The Learning Mate provides a public API for programmatic access to certain Services. Use of the API is subject to these Legal Terms and the following additional conditions:

API Access and Authentication

  1. API Keys: To access the API, you must generate an API key from your account dashboard. API keys are unique to your account and must be kept confidential.
  1. Authentication: API requests must include your API key in the Authorization header as a Bearer token.
  1. Security: You are solely responsible for maintaining the security of your API keys. If you believe your API key has been compromised, immediately deactivate it through your account dashboard and generate a new key.

Rate Limits

API usage is subject to rate limiting to ensure fair usage and system stability:

  • Standard endpoints: 5-20 requests per hour depending on endpoint

  • Bulk operations: Lower limits may apply to resource-intensive operations

  • Quota enforcement: API usage counts toward your subscription quota for exam corrections

Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses. If you require higher rate limits, please contact support@thelearningmate.com to discuss enterprise options.

Acceptable Use

You agree to use the API only for:

  • Integrating The Learning Mate services into your educational workflows

  • Automating exam grading and student management tasks

  • Accessing your own data and student data you're authorized to manage

You agree NOT to use the API to:

  • Circumvent usage quotas or subscription limits

  • Scrape or extract large volumes of data for purposes unrelated to your educational use

  • Build competing services or reverse-engineer The Learning Mate functionality

  • Overload or disrupt The Learning Mate servers through excessive requests

  • Access data belonging to other users without authorization

API Changes and Deprecation

We may modify, update, or deprecate API endpoints at any time. We will provide reasonable notice of breaking changes when possible, but cannot guarantee backward compatibility indefinitely. We recommend:

  • Monitoring API version announcements

  • Implementing error handling for API changes

  • Avoiding reliance on undocumented API behavior

API Availability

API access is provided "as is" without guaranteed uptime or availability. We may suspend API access for maintenance, security incidents, or violations of these terms.

Administrator API Access

Instructors with appropriate permissions may use the API to:

  • Create and manage students in their courses

  • Submit exams for grading

  • Retrieve grades and feedback

  • Update exam metadata

  • Control student visibility of graded exams

All API operations are logged and subject to the same permissions as the web interface.

18. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

19. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.

20. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of Egypt. You and The Learning Mate agree that any dispute arising out of or relating to these Legal Terms or the Services shall be brought exclusively in the competent courts located in Cairo, Egypt, and each party irrevocably submits to the personal jurisdiction of those courts.

21. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

22. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (3) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES.

(1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties set forth in these Legal Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; (6) any overt harmful act toward any other user of the Services with whom you connected via the Services; (7) your upload or submission of student data without proper authorization or consent; (8) your use of AI grading results without appropriate review or verification.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

25. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

Backup Recommendations: We strongly recommend that you maintain your own backups of critical exam data and student records. While we perform regular backups for disaster recovery, these backups are for our operational purposes and may not be available for individual data recovery requests.

26. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing.

YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

27. MISCELLANEOUS

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.

If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.
